The Piney Creek Recreational Association has recently had feedback from members related to the Safety Break protocol at the pool. Please understand that adult swim is not permitted by the Federal Housing Administration (FHA). It is considered discrimination based on age. There have even been court cases regarding this matter, even at a nearby community. It is important to note that the Association didn’t previously have adult swim. Instead, we had 15 minute safety checks each hour. At the end of last pool season, a homeowner came to the Board to complain about the frequency of the safety checks and the fact that adults were still being allowed to use the pool during these checks. The Board immediately revised the pool rules to clarify the fact that adults are not to be in the pool during the safety checks. The frequency of safety checks was also reduced to every two hours, in an effort to inconvenience people as little as possible.
The safety checks are used for multiple purposes, including, but not necessarily limited to, clearing the pool and giving lifeguards a clear view of the bottom of the pool to ensure there are no problems with the pool itself or anything in the pool that might possibly cause harm to someone, giving the lifeguards a break to keep them fresh and allow them to use the restroom (this purpose may not always be as relevant, depending on the staffing at any given time), ensuring swimmers are taking breaks and hopefully using the restrooms themselves, and giving the guards an opportunity to check the bathrooms, clean the pool deck, etc. (again, this may not always be relevant depending on the number of guards staffed at any given time).
As Adult Swim is not permitted by the FHA and the Association cannot legally defy FHA guidelines. We have requested that the lifeguards keep the lap lane clear for lap swimmers and you are always welcome to bring any concerns to the Association’s attention.
