Antennae No television or other antennae, microwave dish
transmitting apparatus, etc., shall be erected on the exterior of any structure or placed on any residential lot within Piney Creek. Exception: Telecommunications Act of 1996Piney Creek Maintenance Association, Inc. Architectural Control Committee (ACC)
Guidelines Concerning Satellite Dishes Pursuant to Federal Communication Commission (FCC) Rules
The use of a satellite dish is allowed per the following:
- A "dish" antenna that is one meter (39") or less in diameter and is designed to receive direct broadcast satellite service, including direct-to-home satellite service.
- An antenna that is one meter (39") or less in diameter or diagonal measurement and is designed to receive video programming services via MMDS (wireless cable). Such antennas may be mounted on "masts" to
reach the height needed to establish line-of-site contact with the transmitter. Masts higher than twelve feet may be allowed subject to local permitting requirements.
- An antenna that is designed to receive television broadcast signals. Masts higher than twelve feet may be subject to local permitting requirements.
- Any satellite dishes and antennas over one meter (39") are not covered by the Telecommunications Act of 1996 and FCC Rules and are therefore still prohibited.
- The Act and Rules permit some regulation by the Piney Creek Maintenance Association, Inc., such as the means, method and location of the dish or antenna installation, as long as no "unreasonable" delay or cost
is involved. The Association can still require compliance with building codes, unobtrusive placement, painting, camouflage and other reasonable measures to ensure the safety of the installation and
minimize the visual effect on the community.
- The Association will continue to enforce any guidelines that are acceptable within the parameters of the Act and FCC Rules.
- While the Association will comply with the Act, residents are requested to be sensitive to their neighbors and work with the installers to choose an aesthetically pleasing location for their satellite dish so
that property values are not adversely affected.
- There is no need to file an Architectural Improvement Request Form or to seek approval from the ACC concerning your desire to install a satellite dish (39") or less in diameter. Please pay particular
attention to items #5 and #7 above.
